Legalizing Divorce in the Philippines

A Catholic priest urged Catholics not to support what he called a "bandwagon" seeking to support a proposed measure allowing divorce in the Philippines.

“Even if we are the only country in the world that has not legalized divorce, it does not mean that we have to join the bandwagon that supports it," said Fr. Jerry Oblepias, Director of the Family Life Ministry of the San Pablo Diocese.

In an article posted on the Catholic Bishops Conference of the Philippines (CBCP) website, Oblepias said “divorce remains to be part of the death culture that seeks to destroy the family. Once the family is destroyed, degradation of values is surely at the doorstep."

Some lawmakers had broached the idea of legalizing divorce in the Philippines, after the the dominantly Catholic state of Malta in the Mediterranean voted in favor of allowing divorce in a non-binding referendum.

I highly recommend your service to anyone seriously interested in navigating the Philippine annulment / divorce system. Previously, I wasted money on Philippine lawyers on two separate occasions without result. The first attorney, found by my mahal, actually stole the 150,000 pesos we gave him and ran off to Leyte when we started asking him questions. The first lesson is do not let your mahal look for an attorney unless she is already in the higher strata of Philippine society, most unlikely, because she will be ripped off quicker than we will in that circumstance. My impression is most Filipino lawyers are very poor and more likely to rip you off than get you justice. If you give them the money to pay the court they will pocket it without solving a case like this. In fact, the original attorney made our case worse with the messed up documents he did file. According to our next attorney there are even fake ones out there. So, I found the next attorney but did not ask for expat references. He promised it would work, especially since my mahal's ex was not going to contest it. He said it would not take a bribe but it would take about 18 months. Three years later it ended up in the Court of Appeals with minimal chances of success. Basically, I paid the attorney a large retainer and endless appearances to the point I probably dropped another 200,000 and three years to actually make the case worse! We may have paid more since it happened over three years but it was more than frustrating and the court kept dropping hints to my mahal they wanted a bribe that we never paid on the advice of our second attorney. Besides, he got paid if we consider he was paid everytime we went to court and if we lost he already had his money.

In desperation, I searched again and found xxxxs email mentioned from an expat living in the Philippines website. He quoted a price and promised it would work so we took a chance. Two months later we have our result, as promised, and it was much better dealing with an expat than Filipinos on this matter. Best of luck if you are considering an annulment in the Philippines but unless you have a judge as your mahal's relative who promises to do this for you then I do not believe you are on the right track. If you insist on using a Filipino to do your annulment I highly suggest you do not give them all the money up front because in my experience that is a recipe to just lose all of your money. On the other hand, even after being ripped off twice I gave XXXl a chance after hearing how he was going to assure this result. It was reassuring he was willing to meet first and after giving 10,000 pesos to hear how he would do it I gave the rest of the amount to do it. xxxxl delivered in the time promised and in the exact manner he said he would do it. If you have any questions I will gladly answer them for you but I will protect the sanctity of his process. Besides, knowing his process would not work unless you had his connection anyway. Too tired to love again: Claiming her heart is tired from too much journeying, Kris Aquino says, on the occasion of an album launch, that she needs to take a long rest in the romance department for the meantime.

She pooh-poohed any romantic connection with several men currently being linked to her, picking out Diether Ocampo with whom she said she enjoys a relationship that doesn’t go beyond friendship.

In a playful mood, Kris joked that she told singer Jed Madela one time she wanted to marry him as soon as she finished her annulment.

The casual offer floored Madela, who was one of four singers who guested at the album launch held at a Quezon City restaurant March 5.

In the middle of an annulment case with estranged husband James Yap, Kris said the situation has been so draining she wants to rest her heart for a long, long time. The actress and presidential sister testified at a court hearing recently, noting that going through an annulment can be a harrowing experience she will never want to re-live.

Easier Annulment

A bill has been put forward in the Philippine Congress aimed at making it easier for poor people to get their marriages annulled.

The bill would make violence, infidelity and abandonment all grounds for annulment.

The Philippines is one of the few places in the world - alongside the Vatican and Malta - where divorce is still prohibited.

Annulments are currently too expensive for anyone but the rich to contemplate.

First, couples have to prove that their marriage licence is not valid or that one person is, in legal terms at least, psychologically incapacitated.

It is an expensive procedure, and Congressman Neri Colmenares says the system discriminates against those who cannot afford to hire lawyers and psychiatrists.

Divorce is a controversial topic, except that it’s often discussed with hushed voices. Many are just waiting for the right opportunity to end their respective marriages, and the reasons are diverse — physical abuse (against the spouse and/or the children), sexual infidelity, irreconcilable differences and conflicting personalities, gross irresponsibility, loss (and transfer) of affection, among others. Unfortunately, these grounds are not enough to severe the marital bond through annulment. In lieu of divorce, married persons resort to annulment and according to the Office of the Solicitor General (OSG), there is an alarming increase in the number of annulment cases in the Philippines. The number of annulment cases filed in courts, which never breached the 7,000-mark prior to 2006, rose to 7,138 (2006) and 7,753 (2007).

Existing Philippine Laws regarding Divorce

Philippine laws do not provide for absolute divorce, but divorce was available in certain periods in Philippine history. Divorce was allowed under the Divorce Law of 1917 (Act No. 2710) and during the Japanese occupation, pursuant to Executive Order No. 141 (1943). As the law stands today, however, a marriage between two Filipinos cannot be dissolved even by a divorce obtained abroad. In mixed marriages involving a Filipino and a foreigner (or former Filipinos), Article 26 of the Family Code allows the former to contract a subsequent marriage in case the divorce is validly obtained abroad by the alien spouse capacitating him or her to remarry.

It is not really accurate to say that there is absolutely no divorce in the Philippines. Under Presidential Decree No. 1083, also known as the “Code of Muslim Personal Laws of the Philippines,” divorce is allowed in certain instances, but this law applies only when both parties are Muslims, or wherein only the male party is a Muslim and the marriage is solemnized in accordance with Muslim law in any part of the Philippines. For the rest of Filipinos, therefore, divorce is not available.

A controversial bill to legalize divorces in the Philippines has stirred controversy among congress members in the archipelago.

The bill, House Bill No. 1799, also known as “An Act Introducing Divorce in the Philippines” was filed by Congresswomen Luzviminda Ilagan and Emerenciana De Jesus on July 27. Both congresswomen are members of the political party group Gabriela Women’s Party, which focuses on advancing women’s rights in the Philippines.
Currently, it is illegal to obtain a divorce in the Philippines. An annulment or legal separation is recognized by the government, according to the Family Code, executive order number 209, signed July 26, 1987.
“Reality tells us that there are many failed, unhappy marriages across all Filipino classes,” wrote the two congresswomen in HB 1799’s explanatory note.

“In the Filipino culture, marriage is regarded as a sacred union, and the family founded on marriage is considered as a fount of love, protection and care. Philippine society generally frowns upon and discourages marital break-ups and so provides cultural and legal safeguards to preserve marital relations. Cultural prescriptions and religious norms keep many couples together despite the breakdown of the marriage,” the bill added.
Walden Bello, a member of the House of Representatives, publicly supports the proposed divorce bill. “Let’s join the 20th century,” said Bello.
The Philippines is predominantly Roman Catholic, where marriage is highly revered and divorce is not an option. Congressman Ben Evardone has publicly opposed the bill. “We must continue to work for the preservation of the sanctity of marriage and the family,” said Evardone. ”Legalizing divorce might encourage or promote destruction of families.”
“With the predominance of the Catholic faith in the Philippines, the fear that divorce will erode personal values on marriage appears unfounded,” stated congresswomen Ilagan and De Jesus.
“This bill is being introduced based on indications that Philippine society is ready for the legalization of divorce. The sanctity of marriage is not based on the number of marriages existing but on the quality of marital relationships,” they added.
According to the Family Code, a marriage may be annulled for various reasons, such as if a bride or groom was married without the consent of their parents and is under 21 years old. Other factors include that the marriage was forced and not voluntary or if either spouse had an “incurable” sexual transmitted disease.
A legal separation may be granted if there was physical abuse in the relationship, drug or alcohol abuse, homosexuality or infidelity among other factors, according to the Family Code.

13a permanent visa

This is a response about the 13a visa from a friends correspondence. I have removed names.

Sorry to say this but you are in error regarding the 13a permanent visa. Your theory that you are a permanent residence unless you are divorced is not correct. The wife can apply to withdraw her support to her husband on many grounds and even to simply be spiteful. However losing your 13a does not necessarily mean you will have to leave the country. The answer provided by the BI is that you apply to have your 13a residence visa downgraded back to tourist. Just pay the 2 monthly fees then you are free to do whatever you desire. The BI are aware of women making vexatious complaints against their husband for many reasons and deportation is not a preferred option for the BI. Many filipino's believe it is a simple matter to have some person deported but that is quite incorrect.

Most foreigners meet their Filipinas from the Internet dating/friendship sites and sometimes by word of mouth. The latter is in most cases the best thing. Most of the foreigners are retired and have been divorced or widowed or never married and are seeking a friendly companion in their autumn years.

The Philippines is a popular country in which to retire in due to the abundance of smiling, happy and willing women who do not have the attitude against age, that is often found in the west. A huge plus is the fact that it is CHEAPER to live here in the Philippines, but of course normally the new wife wants to see the world.

Many of the Filipinas looking for partners through the internet are desperately searching for a better way of life so a 20 years old woman corresponding intimately with an often-overweight 60, 70-year-old foreigner is very common. Hasten to add, I am saying for sure that's NOT me, I have no girlfriend, and am not looking to marry, but most of my friends are. Many of the women and (their immediate family) expect the foreigner to marry them, and when you marry a lady here you marry the WHOLE extended family, a family that can be a constant request for money, sorry but that is the norm. Frequently, there is an impediment to a marriage as the woman is already married but separated from her spouse. There are many women in this situation simply because they do not have sufficient money to pay the attorneys.,for the annulment, that can last years too.

There is no divorce available under current Philippines law, although an annulment of a marriage is possible through the courts system. Many law firms specialize in handling annulments, however, the legal and court system in the Philippines is often slow!!!!
But there is a legal way to fast track

As well, the costs annulments are significant with attorney fees, court docketing and filing fees plus a host of associated fees such as court appearance fees for the attorney and often the account can reach huge monies. Unfortunately, if a foreigner is involved the legal fees can increase also and the longer the case takes to appear before the judge the greater the income to the legal team.

Nevertheless, there is an alternative way to obtain a legal dissolution of marriage at a much reduced cost. It is simple and only requires the Filipina to file a case against the husband. The woman does not have to appear personally and the court officials will prepare all of the necessary documentation. A senior judge will hear the divorce action and a decision handed down ordering the marriage legally dissolved. The Judges decision will be recorded by the Court and the whole procedure takes a maximum of two months or even quicker.

The woman then takes the court order to the local Civil Register of the place her marriage had been solemnized and requests her previous marriage to be rendered null and void.

When that is completed, she is free to remarry in any religious ceremony under her maiden name.

This is done by a friend of mine here, and seems to satisfy many people, but its not a cheap alternative, but it is quick and legal. I do not need to partake in this, but I know many that do, and I know people queuing to get this done.
